Terms and conditions of use of the SIMPLIX platform

  1. Acceptance of terms
  • General Conditions: By accessing and using SIMPLIX, the user agrees to comply with these terms and conditions.
  • Updates: SIMPLIX may update these terms at any time. The modifications will be effective once published on the platform.
  • Legal Reference: Law 527 of 1999.
  1. Intermediation Function
  • Role of SIMPLIX: SIMPLIX acts solely as an intermediary between users and service providers. It does not guarantee the quality or execution of the services.
  • Exclusion of Liability: SIMPLIX is not responsible for the quality, safety or legality of the services provided by the providers.
  • Legal Reference: Commercial Code, Article 863.
  1. Limitation of Liability
  • Exclusion of Damages: SIMPLIX will not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use of the platform.
  • Indemnification: The user agrees to indemnify and hold SIMPLIX harmless against any claim arising from the use of the platform.
  • Legal Reference: Colombian Civil Code, Articles 1604 and 1608.
  1. Privacy and Data Protection
  • Privacy Policy: SIMPLIX is committed to protecting the privacy of users and managing their personal data in accordance with Law 1581 of 2012.
  • Use of Data: The personal data collected will be used only for fines authorized by users.
  • Legal Reference: Law 1581 of 2012 and Decree 1377 of 2013.
  1. Modification of Terms
  • Updates: SIMPLIX reserves the right to modify these terms and conditions at any time. The modifications will be notified to users and published on the platform.
  • Acceptance of Modifications: Continued use of the platform implies acceptance of the modifications.

  1. Jurisdiction and Applicable Legislation
  • Applicable Law: These terms and conditions will be governed and interpreted in accordance with Colombian law.
  • Dispute Resolution: Any controversy will be resolved by the Colombian courts.

  1. Use of the Platform
  • Access and Use: Users must use the platform responsibly and in accordance with the law. Use of the platform for illegal or unauthorized activities is not permitted.
  • Suspension of Accounts: SIMPLIX reserves the right to suspend or terminate accounts that violate these terms.
  • Legal Reference: Law 527 of 1999 and Colombian Penal Code.
  1. Advertising and promotions
  • Promotional content: SIMPLIX may include advertising and promotions on the platform. The terms of said promotions will be specified on the platform.
  • Third Party References: The inclusion of links or references to third party sites does not imply endorsement by SIMPLIX.

  1. Contact and support
  • User Support: SIMPLIX will offer support to users through the channels indicated on the platform.
  • Complaints and Claims: Users can submit complaints and claims through the channels enabled by SIMPLIX.

SIMPLIX Provider Terms and Conditions

  1. Registration and Acceptance of Terms
  • Registration: The provider must register on the SIMPLIX platform providing true, complete and updated information. SIMPLIX reserves the right to verify the information provided.
  • Acceptance: By registering, the provider accepts these terms and conditions, as well as SIMPLIX's privacy policies.
  • Legal Reference: Law 1581 of 2012 (Personal Data Protection Law).
  1. Provider Independence
  • Relationship: The provider acts independently and is not an employee, agent or representative of SIMPLIX.
  • Responsibility: The provider is responsible for complying with all labor, tax and safety regulations applicable to its activity.
  • Legal Reference: Substantive Labor Code, Article 23 and Decree 1072 of 2015.
  1. Responsibility for the Service Provided
  • Service Quality: The provider is solely responsible for the quality, safety and any aspect related to the services provided to users.
  • Indemnification: The provider will indemnify SIMPLIX for any claim related to the services provided.
  • Legal Reference: Commercial Code, Articles 863 and following.
  1. Regulatory Compliance
  • Laws and Regulations: The provider must comply with all local laws and regulations, including consumer protection and workplace safety.
  • Licenses and Permits: The provider must have all the necessary licenses and permits to carry out its activity.
  • Legal Reference: Law 1480 of 2011 (Consumer Statute) and Resolution 2400 of 1979.
  1. Confidentiality and Data Protection
  • Confidentiality: The provider must protect the confidentiality of user information and use it only for authorized purposes.
  • Data Protection: The provider undertakes to comply with Law 1581 of 2012 and Decree 1377 of 2013 regarding the protection of personal data.

  1. Rates and Commissions
  • Commissions: SIMPLIX will charge a commission of 20% of the value of each visit made through the platform. This value is part of the value agreed between the provider and the user.
  • Payments: Payments to providers will be made according to the terms specified on the platform.
  • Legal Reference: Commercial Code, Articles 885 and following.
  1. Digital Wallet and Withdrawals
  • Digital Wallet: Providers will manage a digital wallet on the SIMPLIX platform.
  • Withdrawals: Providers will be able to make up to two weekly withdrawals from their digital wallet.
  • Deadline to Reflect Funds: The withdrawn funds will be reflected in the provider's account within the next 5 business days.
  • Legal Reference: Law 527 of 1999 (Electronic Commerce Law).
  1. Termination of the Relationship
  • Causes for Termination: SIMPLIX may terminate the relationship with the provider for failure to comply with these terms, inappropriate behavior or any other justified cause.
  • Effects of Termination: The termination of the relationship will not affect the rights and obligations that arose before the termination.
